Terms of Service

By purchasing a commission, the client agrees to these Terms and Conditions/Terms of Service. I may periodically update these terms and it is the responsibility of the client to check these prior to working with me. First-person references such as I, me, myself refer to the artist of TheGooseDragon Art, Alex Rougeux. Terms such as client, commissioner, purchaser refers to the person(s) purchasing the artwork.

GENERAL

I reserve the right to refuse a commission for any reason, all work is non-refundable after completion however a refund or partial refund before the artwork is completed will be at the discretion of the artist depending on the amount of work/time that has already been put into the project.Prices are subject to change, but an accurate and full quote will be provided before the client makes any payment. There may be some instances where a charge will be added mid-production – (example: client requesting changes during production) any charges mid-production will be discussed with the client.Commissions are automatically deemed cancelled if the client has not responded or sent payment 10 days after accepting the commission. This does not apply if written arrangements have been made between the artist and the client.I may cancel a commission at any time. If I cancel a commission after it has been paid for, the client will be notified and given a full refund through the platform the commission was paid with.Client will be required to supply the artist with an unshaded 2 sided reference sheet of the character(s), exceptions may apply. Artist has the right to decline a commission due to an unclear reference sheet.

PAYMENT

Payments options: CashApp, PayPalPayments will only be in USD and all payment is required before starting the commissioned work.Payment plans may only be discussed for commissions over $200 – all others are required upfront.No refunds will be given after the sketch has been started unless the artist determines they are unable to continue/execute the commission.
If changes are requested after the sketch phase, the client may be subjected to a fee.All sales are final.Chargebacks issued by the clients financial institution or platform used (PayPal, CashApp, etc.) must be compensated by the client.
PayPal fees may apply to refunds and may be subject to a processing time. Under no circumstances will I use options like PayPal Friends & Family service to expedite this process.Intentionally issuing a chargeback for any reason is prohibited and may result in legal action to which client will also be financially responsible for the reimbursement of artists court fees.

PUBLISHING &
COMMERCIAL USE

I reserve the right to display/post completed artwork for advertising & self-promotion purposes unless the client explicitly requests their commission be private. This must be stated before the artwork has been completed.The client may print, post, and share any of their purchased work for personal use but may not be used for profit. All credits may be linked to any of my social media or credit with TheGooseDragonWhen publishing the commissioned artwork, the commissioner must ensure the credit signature remains intact and visible on the artwork. If the signature is removed/cut off due to cropping, the client is not required to move or rewrite my signature on the cropped work.Any commercial-use commissions will be on a case-by-case basis and may result in additional fees/contracting. Please contact me at [email protected] for any commercial use inquiries.Any commercial-use work must be granted permission in writing before a client may use it for their merchandise or brand.Royalty rates may apply to any commercial-use commission and will be discussed with the commissioner prior to purchase.None of my work may be used for non-fungible tokens (NFTs), artificial intelligence generators (AI) including use for learning data, cryptocurrency or any other similar use, regardless if for profit or not. I will not accept projects involving such listed subjects and unauthorized use for subjects listed above is considered theft of intellectual property.Any unauthorized use of artwork by TheGooseDragon may result in legal action.

QUEUE & PROCESS

All commissions are listed on my public queue located on my TrelloPosition in queue may shift depending on payment/response time.Every commission is subject to a turnaround time which will be given when the full payment is received.Turnaround time will be different for each commission because larger orders will require more time.All clients will be given work-in-progress updates and asked to confirm that the piece is how they want it. Changes are to be requested in the sketch phase. Any changes in the characters design or major changes requested after the sketch phase will require approval by the artist and may be subject to a fee. This is at the artist's discretion.Client may request edits such as color adjustments or artist error after the work is completed. Major changes may be subject to a fee.
